1. Acceptance

By creating an account or using the ORQENZA platform, you agree to these Terms of Use. If you disagree, do not use the platform.

2. Service description

ORQENZA is an AI-powered marketing automation SaaS platform. The service includes content creation, scheduling, and publishing on social media, performance analytics, and multi-channel campaign orchestration.

ORQENZA is not responsible for AI-generated content published on users' social media platforms. Users are responsible for reviewing and approving all content before publication.

3. Account registration

• You must provide accurate and current information when registering
• Your account is personal and non-transferable
• You are responsible for maintaining the confidentiality of your credentials
• Notify us immediately of any unauthorized access: suporte@orqenza.com

4. User responsibilities

You agree to:

• Use the platform only for lawful and legitimate purposes
• Not use the platform to publish illegal, offensive, discriminatory, or third-party rights-infringing content
• Comply with the terms of use of connected social media platforms (Instagram, Facebook, LinkedIn, etc.)
• Keep subscription payments and credits up to date
• Not attempt to circumvent security systems or platform limits

5. Intellectual property

• ORQENZA's code, design, brand, and content are property of ORQENZA
• Content generated by agents from your data belongs to you
• ORQENZA makes no claim of ownership over the data you input into the platform

6. Payments and refunds

• Plans are billed monthly or annually as selected
• AI agent credits are consumed according to usage
• No refunds for already-consumed credits
• Subscription cancellation ends access at the end of the paid period
• Prices may be updated with 30 days' prior notice

7. Availability and SLA

• ORQENZA commits to 99.5% monthly uptime
• Scheduled maintenance will be announced at least 24 hours in advance
• Unplanned downtime under 4 hours/month does not entitle refunds

8. Limitation of liability

ORQENZA is not liable for:

• Data loss caused by your system failure or compromised credentials
• Content published on social platforms from AI agents
• Indirect damages, lost profits, or consequential damages
• Unavailability of third-party APIs (Instagram, Facebook, LinkedIn, etc.)

Our maximum liability is limited to the amount paid in the last 3 months.

9. Termination

• You may cancel your account at any time from the dashboard
• ORQENZA may suspend or terminate your account for Terms violations
• Upon termination, your data will be retained for 30 days for export, then deleted

10. Amendments

We may amend these Terms at any time. We will notify you by email with 15 days' notice for material changes. Continued use after notification implies acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil.
Disputes shall be subject to the exclusive jurisdiction of the courts of São Paulo, SP, Brazil.
